California Requirement

Workers' Compensation in California — What Every Business Owner Must Know

Workers' compensation insurance is mandatory for all California employers — even if you have just one employee. Failure to carry it is a criminal offense that can result in stop orders, fines, and even jail time.

Sole proprietors are generally exempt unless they are roofers. Part-time status does not exempt employees — if someone works for you in California, they are presumed to be an employee under state law.

Penalty for non-complianceA stop order plus fines up to twice the premium owed, or $1,500 per employee per period — whichever is greater. Maximum $100,000 per incident.
What it coversMedical care, temporary and permanent disability benefits, job displacement benefits, return-to-work supplement, and death benefits for dependents.
Death benefits (California)One dependent: up to $250,000. Two or more: up to $290,000–$320,000. Burial expenses up to $10,000.
Filing deadlineInjured employees have one year to file a claim. The employer must provide claim forms and file with the insurer. California DWC can assist with disputes.
